We at EmployeeZ Inc. ("Company", "we", "our", "us") respect your privacy and want you to understand how we collect, use, and share data about you. This Privacy Policy covers our data collection practices and describes your rights regarding your personal data.

Unless we link to a different policy or state otherwise, this Privacy Policy applies when you visit or use the EmployeeZ mobile applications, the EmployeeZ website ("www.employeez.me"), EmployeeZ Live Events website ("api.employeez.me"), EmployeeZ App website ("app.employeez.me"), or related services ("Services").

These Privacy Policy apply to all users ("you", "your", "user", "Seller", "Buyer", "host", "attendee", "visitor") and others who wish to access or use Service. By using the Services, you agree to the terms of this Privacy Policy. You shouldn't use the Services if you don't agree with this Privacy Policy or any other agreement that governs your use of the Services.



1. INFORMATION WE COLLECT

There are two basic categories of information we collect:
1. Information you provide.
2. Information we get when you use our services.


1.1. Information You Provide
--------------------------------------------
• In order to use the Services, you need an EmployeeZ account ("Account"). When you interact with our Services, we collect information that you provide to us. For example, our services require you to set up an account, so we may need to collect a few important details about you, such as your name, email address and password. We may also ask you to provide us with some additional information that will be publicly visible on our services, such as a profile picture, and your branding details.

• You'll also provide us whatever information you send through our services, such as posts, GIGs, comments, messages and media. Keep in mind that the users who view your content can always save that content or copy it outside the app. So, the same common sense that applies to the internet at large applies to our services as well: Don't send messages or share content that you wouldn't want someone to save or share.

• Some services, such as the GIG module, may require you to provide us with a debit/credit card ("Card") number and its associated account information. We do not store your Card information, your Card information is stored by our payment service provider, Stripe Inc. ("Stripe").

• Additionally, we may require you to provide us with your legal name and your full address, your bank account number and its associated account information for withdrawal and payout process and also some legal documents regarding certain tax obligations to the U.S. government.

• When you contact customer support or communicate with us in any other way, we'll collect whatever information you volunteer or that we need to resolve your question.


1.2. Information We Get When You Use Our Services

When you use our services, we collect information about which of those services you've used and how you've used them.

• System Data: Technical data about your computer or device, like your IP address, device type, device name, device language, time zone, operating system type and version, unique device identifiers, browser, browser language, domain and other systems data, and platform types.

• Usage Data: Usage statistics about your interactions with the Services, including content accessed, time spent on pages or the Service, pages visited, features used, your search queries, click data, date and time, referrer, and other data regarding your use of the Services.

• Camera and Photos. Many of our services require us to collect images and other information from your device's camera and photos. For example, you won't be able to send posts or upload photos from your camera roll or download any media unless we can access your camera or photos.

• Approximate Geographic Data: An approximate geographic location, including information like country, city, and geographic coordinates, calculated based on your IP address.



2. HOW WE USE INFORMATION

We use your data to do things like provide our Services, communicate with you, troubleshoot issues, secure against fraud and abuse, improve and update our Services, analyze how people use our Services, and as required by law or necessary for safety and integrity. We retain your data for as long as it is needed to serve the purposes for which it was collected. We use the data we collect through your use of the Services to:

• Provide and administer the Services, including to facilitate participation in content, display customized content, and facilitate communication with other users;

• Process payments to Sellers and other third parties;

• Process your requests and orders for GIGs;

• Communicate with you about your account by:
•• Responding to your questions and concerns;
•• Sending you administrative messages and information, notifications about changes to our Service; and updates to our agreements;
•• Sending notifications to your device and transactional emails to you to provide updates and other relevant messages regarding your account or our Service;
•• Sending marketing emails to you to provide updates and other relevant messages regarding your account or our Service;

• Manage your account and account preferences and personalize your experience;

• Facilitate the Services' technical functioning, including troubleshooting and resolving issues, securing the Services, and preventing fraud and abuse;

• May automatically store a recording of an event with the purpose of using it exclusively for mitigating/resolving user disputes of the Service;

• Verify the identity of Sellers;

• Solicit feedback from users;

• Identify unique users across devices;

• Improve our Services and develop new products, services, and features;

• Analyze trends and traffic, track purchases, and track usage data with the help of analytics service providers;

• Advertise the Services on third-party websites and applications;

• As required or permitted by law; or

• As we, in our sole discretion, otherwise determine to be necessary to ensure the safety or integrity of our users, employees, third parties, the public, or our Services.



3. WHO WE SHARE YOUR DATA WITH

We share certain data about you with other users, companies performing services for us, and analytics providers. We may also share your data as needed for security, legal compliance, or as part of a corporate restructuring.


3.1. With other users
--------------------------------------------
We may share the following information with other users:

• Information about you, such as your name, profile picture, profile information.

• Information about how you have interacted with our services, such as your total likes, your GIGs, your posts and post count, your followers and your following.

• Information about your device, such as the operating system and device type, to help you receive content in the optimal viewing format.


3.2. With Service Providers, Contractors, and Agents

We share your data with third-party companies who perform services on our behalf, like payment processing, accounting (for tax obligations), IP geolocation, fraud and abuse prevention, email and hosting services, and customer services and support. These service providers may access your personal data and are required to use it solely as we direct, to provide our requested service.


3.3. With Analytics Services

As part of our use of third-party analytics tools like Google Analytics and data enrichment services, we share certain contact information, Account Data, System Data, and Usage Data. This allows these providers to provide analytics services. We do this to communicate with you in a more effective and customized manner.


3.4. For Security and Legal Compliance
--------------------------------------------
We may disclose your data to third parties if we (in our sole discretion) have a good faith belief that the disclosure is:
Permitted or required by law;

• Requested as part of a judicial, governmental, or legal inquiry, order, or proceeding;

• Reasonably necessary as part of a valid subpoena, warrant, or other legally-valid request;

• Reasonably necessary to enforce our Terms of Use, Privacy Policy, and other legal agreements;

• Required to detect, prevent, or address fraud, abuse, misuse, potential violations of law (or rule or regulation), or security or technical issues; or

• Reasonably necessary in our discretion to protect against imminent harm to the rights, property, or safety of EmployeeZ, our users, employees, members of the public, or our Services.

• We may also disclose data about you to our auditors and legal advisors in order to assess our disclosure obligations and rights under this Privacy Policy.


3.5. During a Change in Control

If EmployeeZ undergoes a business transaction like a merger, acquisition, corporate divestiture, or dissolution (including bankruptcy), or a sale of all or some of its assets, we may share, disclose, or transfer all of your data to the successor organization during such transition or in contemplation of a transition (including during due diligence).


3.6. After Aggregation/De-identification

We may disclose or use aggregated or de-identified data for any purpose.


3.7. With Your Permission
--------------------------------------------
With your consent, we may share data to third parties outside the scope of this Privacy Policy.



4. SECURITY
--------------------------------------------
We use appropriate security based on the type and sensitivity of data being stored. As with any internet-enabled system, there is always a risk of unauthorized access, so it's important to protect your password and to contact us if you suspect any unauthorized access to your account.

EmployeeZ takes appropriate security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal data that we collect and store. These measures vary based on the type and sensitivity of the data. Unfortunately, however, no system can be 100% secured, so we cannot guarantee that communications between you and EmployeeZ, the Services, or any information provided to us in connection with the data we collect through the Services will be free from unauthorized access by third parties. Your password is an important part of our security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe your password or account has been compromised, you should change it immediately and remove any session not belonging to you upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security). You can change your password under the menu "EmployeeZ App > Profile > Preferences > Accounts" and check "the sessions with your login credentials" under the menu "EmployeeZ App > Profile > Preferences > Sessions". Once a session is removed, the session of the target EmployeeZ app will be expired. This expiration may take up to twenty minutes.



5. YOUR RIGHTS

You can access, update and delete your personal data that EmployeeZ collects and maintains as follows:

• To update data you provide directly, log into your account and update your account at any time.

• You can delete your account under the menu "EmployeeZ App > Profile > Preferences > Accounts".

• You can initiate account deletion via https://app.employeez.me/delete-account-request

• If you are a Seller, you cannot delete your account if you have active GIG tickets. In order to delete your account, you have to cancel all active tickets first.

• Please note: even after your account is terminated, some or all of your data may still be visible to others, including without limitation any data that has been (a) copied, stored, or disseminated by other users (including comments on content); (b) shared or disseminated by you or others (including in your shared content); or (c) posted to a third-party platform. Even after your account is terminated, we retain your data for as long as we have a legitimate purpose to do so (and in accordance with applicable law), including to assist with legal obligations, resolve disputes, and enforce our agreements. We may retain and disclose such data pursuant to this Privacy Policy after your account has been terminated.



6. USERS IN CALIFORNIA

Users who are California residents have certain rights under the California Consumer Privacy Act, ("CCPA"). If you are an eligible California user, included in these rights are:

• "Right to Know" - You have the right to request to know more about the categories and specific pieces of personal information that we have collected about you and access a copy of your personal information.

• "Right to Correction" - You have the right to have inaccurate personal information about you corrected.

• "Right to Deletion" - You have the right to request deletion of personal information that we have collected about you.

• "Right to Non-Discrimination" - If you choose to exercise any of your rights under CCPA, EmployeeZ will treat you like all other users. In other words, there is no penalty for exercising your rights under CCPA.

• "Right to Opt-Out" - You have the right to opt out of the sale of your personal information.

CCPA has a specific definition of a "sale" and while EmployeeZ does not, in the traditional sense, sell your personal information or the personal information of any of our users. To exercise any of these rights under CCPA, please email via www.employeez.me/contact



7. USERS IN NEVADA

EmployeeZ does not sell its users' personal information or personal data. Nonetheless, Nevada residents have the right to submit a request that we do not sell your covered personal information, which you can do by emailing via www.employeez.me/contact



8. USERS IN THE EUROPEAN ECONOMIC AREA ("EEA") AND UNITED KINGDOM ("UK")

If you are located in the EEA or UK, you have the right to request access to your data in a portable format and to request the rectification, erasure, restriction of processing, or objection to processing of your personal data. Additionally, if you are located in the EEA, UK, or Switzerland, you also have the right to lodge a complaint with your supervisory authority.



9. USERS OUTSIDE OF THE U.S.

In order to provide the Services to you, we must transfer your data to the United States and process it there. If you are using the Services from outside the United States, you consent to the transfer, storage, and processing of your data in and to the United States or other countries.



10. CHILDREN
--------------------------------------------
Our services are not intended for - and we don't direct them to - anyone under 13. And that's why we do not knowingly collect personal information from anyone under 13. In addition, we may limit how we collect, use, and store some of the information of EEA and UK users between 13 and 16. In some cases, this means we will be unable to provide certain functionality to these users. If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent, we may require your parent's consent before we collect and use that information.



11. UPDATING THIS PRIVACY POLICY

From time to time, we may update this Privacy Policy to clarify our practices or to reflect new or different practices (such as when we add new features), and EmployeeZ reserves the right in its sole discretion to modify and/or make changes to these Privacy Policy at any time. Sometimes, we'll let you know by revising the date at the top of the Privacy Policy that's available on our website and mobile application. If we make any material change, we will notify you using prominent means, such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Privacy Policy shall supersede all previous Privacy Policy. If you do not want to agree to these or any updated Privacy Policy, you can delete your account under the menu "EmployeeZ App > Profile > Preferences > Accounts"
